4. Payment Terms

4.2 Payment Schedule: Payment terms will be outlined in your specific project agreement. Typically, we require:

  • 30% deposit upon contract signing
  • 40% at design development phase
  • 30% upon project completion

4.3 Late Payments: Late payments may incur interest charges at 1.5% per month.

4.4 Additional Costs: Client is responsible for additional costs including permits, third-party consultations, and material upgrades beyond the original scope.

5. Project Timeline and Delays

5.1 Timeline: Project timelines are estimates and may be affected by factors beyond our control.

5.2 Client Delays: Delays caused by client decisions, approvals, or changes may extend the project timeline and incur additional fees.

5.3 Force Majeure: Neither party shall be liable for delays caused by circumstances beyond reasonable control, including natural disasters, government actions, or material shortages.

6. Intellectual Property

6.1 Design Ownership: All designs, drawings, and concepts remain the intellectual property of A Bennet Design until full payment is received.

6.2 License: Upon full payment, clients receive a license to use the designs for the specified project only.

6.3 Portfolio Rights: A Bennet Design reserves the right to photograph completed projects and use them for portfolio and marketing purposes, unless otherwise agreed in writing.

7. Client Responsibilities

Clients are responsible for:

  • Obtaining necessary permits and approvals from local authorities
  • Providing accurate site measurements and conditions
  • Making timely decisions and approvals
  • Communicating any changes in project scope or requirements
  • Ensuring compliance with local building codes and regulations

8. Limitation of Liability

8.1 Professional Standards: A Bennet Design will perform services in accordance with industry standards and best practices.

8.2 Liability Limit: Our total liability shall not exceed the total amount paid by the client for the specific project.

8.3 Consequential Damages: We are not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.

9. Termination

9.1 By Client: Clients may terminate the agreement with written notice. Fees will be due for all work completed up to the termination date.

9.2 By A Bennet Design: We reserve the right to terminate services for non-payment, unreasonable client behavior, or breach of these terms.

9.3 Effect of Termination: Upon termination, all outstanding payments become due immediately, and any advance payments are non-refundable.

10. Warranty and Disclaimer

10.1 Design Warranty: We warrant that our designs will be free from material defects in workmanship for a period of one year from completion.

10.2 Disclaimer: We do not guarantee that designs will meet all local building codes or that construction will be free from defects. Clients should engage qualified contractors and obtain appropriate inspections.

11. Dispute Resolution

11.1 Negotiation: Parties agree to first attempt to resolve disputes through good faith negotiation.

11.2 Mediation: If negotiation fails, disputes will be submitted to mediation before pursuing other remedies.

11.3 Governing Law: These terms are governed by the laws of the State of [State] without regard to conflict of law principles.

12. Changes to Terms
